This Privacy Policy explains how Upturn Technologies LLC (“Upturn Technologies LLC”, “we”, “us”, or “our”), which operates the Clear Builders USA platform (the “Service”), collects, uses, discloses, and protects information. By using the Service you agree to this Policy. If you do not agree, please do not use the Service.

1. Who we are

Clear Builders USA is software for construction and remodeling businesses to manage leads, quotes, approvals, change orders, invoices, payments, projects, and scheduling. 2. Information we collect

a. Information you provide

Account data: name, email, password (stored hashed), and business details you enter during sign-up and setup.
Business content: data you create in the Service — contacts, leads, quotes, invoices, payments, projects, expenses, messages, files, and similar records.
Customer information you input: details about your own clients (such as names, emails, phone numbers, and addresses) that you choose to store.
Support & communications: messages you send us, support tickets, and chatbot conversations.

b. Information collected automatically

Usage & device data: IP address, device/OS/browser, pages viewed, and actions taken, used for security and product analytics.
Login & security telemetry: sign-in time, IP, approximate location (derived from IP), and device, used to protect accounts.

c. Payment information

Subscription payments are processed by Stripe. We do not store your full card number; Stripe handles card data under its own privacy and security terms.

3. How we use information

Provide, operate, maintain, and improve the Service;
Create and manage your account and business workspace;
Process subscriptions and payments;
Send transactional and service messages (e.g., verification, receipts, notifications);
Provide customer support and respond to requests;
Monitor, secure, and prevent fraud or abuse of the Service;
Analyze usage to understand and improve features;
Comply with legal obligations.

4. Legal bases

Where applicable law requires a legal basis, we rely on: performance of our contract with you; our legitimate interests in operating and securing the Service; your consent (where requested, such as certain analytics); and compliance with legal obligations.

5. How we share information — service providers (subprocessors)

We do not sell your personal information. We share data only with vendors who process it on our behalf to run the Service:

Stripe — payment processing
Supabase — database and application data storage
Hostinger — web hosting / infrastructure
Resend — transactional email delivery
PostHog — product analytics
Google (Gemini) — AI assistant / chatbot responses
Calendly — demo scheduling (marketing site)

We may also disclose information to comply with law, enforce our agreements, protect rights and safety, or in connection with a merger, acquisition, or sale of assets (with notice where required).

6. Data retention

We retain your information for as long as your account is active and as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements. You may request deletion as described below; some data may be retained where required by law.

7. Security

We use technical and organizational measures to protect your data, including encryption in transit, hashed passwords, access controls, and audit logging. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

8. Your rights & choices

California (CCPA/CPRA)

California residents may request access to or deletion of personal information and may opt out of the “sale” or “sharing” of personal information. We do not sell personal information. We honor Global Privacy Control / Do-Not-Track signals for analytics where supported.

European Economic Area, United Kingdom & other regions

If you are located in the EEA, the UK, or another jurisdiction with comparable data-protection laws, you may have the right to access your personal data; request correction (rectification) or erasure; restrict or object to processing; obtain data portability; and withdraw consent where processing is based on consent. Where we rely on legitimate interests, you may object to that processing. You also have the right to lodge a complaint with your local data-protection supervisory authority. 9. Children’s privacy

The Service is intended for businesses and users aged 18 and over. It is not directed to children, and we do not knowingly collect personal information from anyone under 18.

10. International users & data transfers

We are based in the United States and offer the Service to customers in multiple countries. Your information is processed in the United States and in other locations where our service providers operate. When we transfer personal data from the EEA, the UK, or other regions, we rely on appropriate safeguards where required, such as the European Commission’s Standard Contractual Clauses (and the UK Addendum). By using the Service, you understand your information may be transferred to and processed in the United States and other countries, which may have different data-protection laws than your own.
